The company Fairplace has its corporate headquarters at Paanderstraat 76 in 8791 Waregem (in the province of West Flanders, Belgium, near Kortrijk). The offices and warehouse are situated in Kortrijk, Rijselsestraat 23 (Business centre K-orner, part of HangarK).

The following general terms and conditions apply to the sale of toys and game material through the online store:
Application
Every order through the websites www.fairplace.be and www.fairplace.nl leads to a sales agreement between Fairplace (hereinafter referred to as 'seller') and a client (hereinafter referred to as 'buyer').
Order and payment
An order is legally valid as soon as the buyer receives an order confirmation. Whoever places an order with the seller is deemed to be of legal age and agrees to the delivery and payment conditions.
All our prices are listed in euro and include 21% VAT. The shipping costs are charged extra but are clearly indicated when the buyer completes his order and pays. The seller reserves the right to change or correct the displayed prices and product information at any time.
Fairplace cooperates with its partner for a secure payment environment. This payment platform is integrated in the online store. Payment can be made by credit card (Visa or Mastercard), Bancontact/Mister Cash, Maestro, PayPal or iDEAL (The Netherlands).
Delivery
Products are currently only delivered in Belgium, France and the Netherlands. The seller tries to deliver the ordered products as soon as possible and gives an indicative delivery time to the buyer. We emphasize that this is just an indication and that the seller cannot be held responsible for delays that occur beyond his control. Furthermore, the buyer is responsible for correctly entering the delivery address.
The seller’s shipments are made by different partners, mainly Bpost. Fairplace cannot be held liable for any delays that incurred during shipment by Bpost. According to the law of 6th of April 2010, the maximum delivery time is thirty days, unless otherwise agreed. If this delivery period is not feasible, the seller must inform the buyer in time and the buyer has the right to cancel the order, without any additional costs. Any amounts already paid will in that case be refunded within thirty days.
Retention of title
The ordered goods remain the property of Fairplace until the full price, including VAT, shipping and other possible costs have been paid. In case of non-payment, we reserve the right to take back the goods, by operation of law and at the buyer’s expense.
Right of retraction and returns
In accordance with the Law of 6th of April 2010, the buyer has 14 days to cancel the purchase of the seller’s products. The buyer must inform the seller in writing (by e-mail [email protected] or by using the contact form on the website) and send the refused products back to the seller, at the buyer's expense. The buyer shall return the products in a solid cardboard box, undamaged and unused, together with written proof of purchase. Under no circumstances will unreported or inadequately stamped returns be credited.
Items that are returned to us under the abovementioned conditions will be refunded by us within a period of ten working days. Shipping costs, incurred by us or by you, will not be refunded, so you will receive the purchase price minus the amount of the shipping costs. However, if it concerns an article that was incorrectly delivered by Fairplace SPRL, we will take care of the shipping costs ourselves.
Warranty
All our articles are subject to the legal warranty period for hidden defects and the warranty in case of consumer purchase. We are responsible for any damage resulting from intentional and gross negligence but cannot be held liable for general or special indirect damage, of any kind, suffered by the buyer.
Complaints
We check all our products before we ship them and ensure proper packaging. The buyer undertakes to check the order upon delivery. Never accept packaging that is damaged during transport and check your shipment immediately upon receipt. If you do notice any damage to the products you ordered, we ask you to inform us immediately. If possible, we ask you to send us a picture of the damaged item by email. Never throw away the packaging before you have established that your shipment is in good condition.

Privacy
Ordering at www.fairplace.be inevitably requires you to provide us with your customer details. We use this information to process your order, to deliver it and to track your payment. This information can only be used for advertising purposes if the buyer gives his permission, but only to the address details of the buyer.
This information will not be passed on, rented or sold to third parties. The buyer always has the right to inspect and correct this information, regulated by the privacy law. On request (with a simple email to [email protected]) we will remove your information from our database. If you have any questions about this privacy statement, you can always contact us. It is our absolute intention to increase confidence in buying toys online and not to betray that.
Electronic evidence and severability
All parties accept the electronic evidence (e.g. email) within the framework of their mutual relations.
If any article of these terms and conditions is declared null and void, this invalidity shall not affect the validity of the remaining articles.
Applicable law
All agreements between Fairplace SPRL and the buyer are subject to Belgian law. The Belgian courts have exclusive jurisdiction.
